Ms. Nicol is an employment law and health care regulatory attorney with both in-house and outside counsel experience. She provides advice and guidance to numerous hospitals and health care clients on how to navigate the maze of regulations involving fraud and abuse, provider reimbursement issues, mergers and acquisitions, licensing, physician contracting, certification, and health information privacy and security. Her practice focuses on physician practice startups, mergers and acquisitions, affiliation agreements and alternative payment models including direct primary care/concierge medicine. She also specializes in physician employment issues including contracting and the enforceability of restrictive covenants and non-competes.
Ms. Nicol is an experienced litigator, having tried cases in federal and state courts and appearing before administrative governmental agencies including the, EEOC, DOL, NLRB, OSHA, and state medical and nursing boards.
Prior to joining BHGR, Ms. Nicol lived abroad in South Australia and was a PhD candidate/Teaching Fellow at the University of Adelaide Law School, where her research focused on a comparative analysis of laws in Australia, UK and the USA governing who ultimately decides whether life-sustaining medical treatment is withheld/withdrawn from terminally ill patients and how this impacts patients’ lives and the community overall. Central to her thesis was the assembly of a Citizens’ Jury to analyze the South Australia Advanced Directives Act with outcomes reported to the South Australian legislature for proposed amendments.
Before living in Australia, Ms. Nicol was Senior Vice President/General Counsel of Nexus Health Systems, Inc., a multi-million-dollar, for-profit, physician-owned company comprised of four separate specialty and acute care hospitals located in Texas and California. Ms. Nicol started her legal career as a federal law clerk to the Honorable Marcia A. Crone, United States District Judge for the Eastern District of Texas and was an associate at Locke Lord LLP in Houston, Texas.
Ms. Nicol received her law degree from Loyola University of Chicago, While at Loyola, she served as a member of the Niagara International Moot Court Team, case note writer for the Loyola Consumer Law Reporter and was honored with a Leadership and Service Award upon graduation. She earned a Bachelor of Science Degree in Journalism, cum laude, from Ohio University and was selected as a Scripps Howard Foundation Wire paid intern in Washington, D.C., where she reported and wrote on a variety of issues for the Scripps Howard Wire Service including issues concerning the Capitol, the Supreme Court, the State Department and the Pentagon.
She is licensed to practice law in both Colorado and Texas, where she is Board Certified by the Texas Board of Legal Specialization.
Ms. Nicol is very active in raising awareness and funding heart research and other initiatives on behalf of the American Heart Association/American Stroke Association (“AHA/ASA”). She is a national spokesperson for the AHA/ASA and serve's on the Executive Committee for the American Heart Association’s Go Red for Women.
When not working, Ms. Nicol enjoys hiking, cycling, cooking, gardening and spending time with her husband, Hamish Nicol, their two sons, Finn and Luke and their Golden-doodle, Buzz.
