Giovanni M. Ruscitti Presents on Construction Defects Issues and Affordable Housing

On May 15, 2017, Giovanni M. Ruscitti served on a 4-member panel hosted by the City of Boulder that explored issues relating to finding a balance between consumer protections, Colorado’s construction defect laws, and the development of condominiums to meet the City’s affordable housing goals.   Giovanni’s presentation focused on the practical difficulties created by Colorado’s construction defect laws on construction professionals and the repair process, and also provided suggestions for modifying Colorado’s Construction Defect Action Reform Act (C.R.S. § 13-20-801, et. Seq.) or “CDARA” so that the statute’s purpose – creating a streamlined process for handling construction defect claims and reducing expensive and time consuming litigation – can be achieved.
