Josh focuses on employment litigation, civil rights and discrimination claims, and public entity work, including law enforcement and land-use litigation. He has litigated a wide range of employment related issues for both private and public sector clients involving discrimination claims based on race, sex, age, national origin, and handicap, "property," "liberty," and "free speech" claims under 42 U.S.C. ' 1983, overtime claims under the Fair Labor Standards Act, retaliatory discharge claims under ERISA, and various contract and tort claims. He is frequently retained to defend law enforcement and jail personnel in civil rights suits involving false arrest, excessive force, and conditions of confinement claims. He has developed considerable expertise in defending constitutional takings, inverse condemnation, judicial review and other state and federal challenges of land-use decisions and ordinances by public entities. Using a risk management approach to public entity matters, Josh frequently provides training to police and sheriffs' organizations on civil liability and employment issues and to County Commissioners on land use issues.
Josh was admitted to practice in Colorado in 1987 and is admitted before the United States District Court, District of Colorado and the United States Court of Appeals, Tenth Circuit. He received his Juris Doctor from the University of Colorado School of Law in 1987 and his Bachelor of Arts with honors in history and environmental studies from the University of California at Santa Barbara in 1983.
