Jon Banashek is a partner at Berg Hill Greenleaf & Ruscitti. His practice emphasizes criminal defense and civil litigation. He started his own firm upon graduation from law school, where he practiced with two different partners for eight years prior to joining BHGR.
Mr. Banashek has represented criminal defendants in a wide variety of matters including federal and state white collar crimes, federal and state drug offenses, crimes of violence, property crimes, sex crimes, computer crimes, extradition, drinking and driving cases, and post-conviction remedies. He also represents criminal defendants in collateral administrative matters such as license revocations, administrative registrations, professional and academic disciplinary proceedings which often accompany criminal charges. Mr. Banashek utilizes investigators, expert witnesses, medical and psychological consultants to provide a comprehensive defense strategy. He has handled criminal defense cases throughout the entire state of Colorado and lectures regularly on search and seizure issues.
Mr. Banashek's civil practice includes water law, complex commercial litigation, residential and commercial construction disputes, tax and trust litigation, medical malpractice, real estate and product liability suits against automobile manufacturers. In the area of personal injury, Mr. Banashek has represented both plaintiffs and defendants in cases involving serious injury and death.
Through his involvement on the Boards of Directors for the Mountain People's Cooperative, Teens, Inc. and the Wild Bear Science School, he also has appeared before municipal and county governments in numerous zoning and use matters.
Mr. Banashek is on the Board of Governors for the Colorado Bar Association, a member of the Boulder County Colorado Criminal Defense, National Association of Criminal Defense Lawyers, and Colorado Trial Lawyers Bar Associations. He is the former Co-Chair of the Criminal Section of the Boulder Bar Association, and is currently the Co-Chair of the Boulder Chapter of the Colorado Criminal Defense Bar. Mr. Banashek is also a member of the Colorado Water Congress and the State Affairs Committee of Colorado Water Congress. He was a member of the Campaign Committee of the Legal Aid Foundation of Colorado for several years and was named the Young Lawyer of the Year by the Boulder Bar Association in 2000. Mr. Banashek co-authored an article on the use and admissibility of polygraph examinations for the Colorado Lawyer. He has been a mentor and guest lecturer at the University of Colorado School of Law Legal Aid and Defender Program.
Mr. Banashek grew up in St. Louis, Missouri and received his B.A. from the University of Missouri. He received his Juris Doctor from the University of Colorado School of Law in 1995. Mr. Banashek lives in Boulder with his wife and two sons. He enjoys spending time with his family, telemark skiing, cycling, practicing yoga and playing tennis.
